Some questions and answers concerning the purchase of waterfront land by non-islanders on Prince Edward Island (PEI) and the Island Regulatory and Appeals Commission (IRAC) process
Yes, non-islanders can buy land on PEI. However, they need to follow certain regulations under the Lands Protection Act.
A non-islander individual can own up to 5 acres of land or 165 feet of shoreline without needing approval from the Executive Council or IRAC.
The IRAC is a quasi-judicial commission established by the Prince Edward Island provincial government. It is responsible for a variety of regulatory functions, one of which includes reviewing and approving land transactions that exceed the thresholds set by the Lands Protection Act.
If a non-islander wishes to buy more land than the limit allows, they must apply for permission to the IRAC, which then makes a recommendation to the provincial Executive Council. The Council, not IRAC, has the final say and can either approve or deny the application based on a variety of factors, including the potential impact on the local community and economy.
The length of the IRAC process can vary depending on the complexity of the transaction, the completeness of the application, and the current workload of the Commission. Contact me for more help.
